What are the types of Amendments in the GST Certificate ?

There are two types of modifications that can be made to your GST registration:

Core Field Amendments

These fields are critical to the registration process, and any modification needs to be reviewed and validated by the GST authorities.

Core Field Amendments involve significant changes like:

  1. Change in business name: It refers to altering the official legal name under which a business operates and is registered with authorities.
  2. Adding or removing stakeholders, such as promoters or partners: This involves introducing new partners or promoters into the business structure or the exit of existing partners or promoters from the business.
  3. Change in business name: refers to the process of updating the registered address of a business under the Goods and Services Tax (GST) system.

    When filing for a change of address in the GST amendment, specific documents must be submitted to verify the new address. Here’s a list of required documents based on the nature of the premises:

  4. For Owned Premises

    1. Property Tax Receipt
    2. Municipal Khata
    3. Copy of Electricity Bill

    For Rented or Leased Premises

    1. Rent/Lease Agreement: A copy of the valid agreement.
    2. Property Ownership Documents: Documents from the lessor proving ownership (e.g., Property Tax Receipt, Municipal Khata).
    3. Copy of Electricity Bill: Recent bill of the rented premises.

    For Shared Premises

    1. Consent Letter: A letter from the owner allowing the use of premises.
    2. Ownership Documents: Like a Municipal Khata or Electricity Bill of the owner.

    If the Rent/Lease Agreement is Unavailable:

    1. Affidavit: An affidavit stating the situation along with supporting documents like an Electricity Bill.

Non-Core Field Amendments:

These changes are less significant and can usually be approved automatically.

These include:

  1. Changes to contact details, such as email and phone numbers.
  2. Modifications to the bank account details.
  3. Changes to authorized signatories.

Which Form is required for Amendments in the GST certificate?

The form GST REG-14 is used to submit an application for amendments in the GST registration, including core changes like the business name, principal place of business, or additional places of business.

What is the timeline for approval of the GST Amendment application?

After submission of GST REG-14, the GST authorities are expected to process the application. The approval or rejection generally occurs within 15 working days from the date of submission.

What are the limitations of Amending GST Registration?

Change in PAN: If there’s a change in PAN , you cannot simply amend your existing GST registration. Instead, you must submit a fresh application for GST registration using the new PAN. This is because the GST system is designed to identify businesses based on their PAN, and a change would mean a different entity.

Change in Constitution of Business: Since changing the legal structure of your business usually leads to obtaining a new PAN, you cannot file an amendment application under the existing GST registration. You will need to cancel the current GST registration and apply for a new one with the new PAN.

Change in Place of Business from One State to Another: If you plan to move your business operations from one state to another, your current GST registration is no longer valid in the new state. Therefore, you cannot simply amend your existing registration. Instead, you must cancel your registration in the original state and file a new application for registration in the new state.
